THE CORPORATION OF TOWNSHIP OF SOUTHWOLD
BY- LAW NO. 2010-19
BEING A BY-LAW TO PRESCRIBE REDUCED LOAD PERIODS
FOR THE TOWNSHIP OF SOUTHWOLD
WHEREAS Subsection 7 of Section 122 of the Highway Traffic Act (R.S.O. 1990, Chapter H.8), as amended provides that municipal corporation or other authority having jurisdiction over a highway may by by-law designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies.
WHEREAS pursuant to Section 11 of the Municipal Act, S.O. 2001, C.25, the Council of the Township of Southwold may provide any service or thing that the municipality considers necessary or desirable for highways.
AND WHEREAS the reduced load period is deemed necessary for the protection of certain highways in The Corporation of the Township of Southwold.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SOUTHWOLD ENACTS AS FOLLOWS:

(1) That the definition of "highway" in this by-law includes common and public road, street, avenue, drive, driveway, place, bridge viaduct or trestle, designed and intended for, or used by the general public for passage of vehicles.
(2) That the definition of a "reduced load period" in this by-law shall mean a reduced load period within the meaning of Section 122 of the Highway Traffic Act.
(1) That all highways within the Township of Southwold over which The Corporation of the Township of Southwold has jurisdiction are hereby designated as being subject to the provisions of this by-law and the provisions of this by-law shall apply to all highways within the Township of Southwold.
(2) That the provisions of Subsections 1, 2, 3 and 4 of Section 122 of the Highway Traffic Act shall apply to all highways within the Township of Southwold during the period from the 1st day of MARCH to the 30th day of APRIL inclusive, in each and every year.
(3) That the Public Works Superintendent may in any year, at his discretion, extend or reduce the load restriction periods.
(1) That Schedule "A" listing the roads and restrictions attached hereto shall form part of this by-law.
That this by-law shall come into effect upon passing.

Reduced load period limits a vehicle axle weight to 5,000 kilograms (five tones) per axle, or half the normal legal loading.
